Rezoning (petition for map amendment)

1. Definition:

  • A Rezoning is required by Park County Land Use Regulations to change the zoning district of your property and is generally limited to rezoning to zones present in adjacent properties. 

2. Procedure:

  1. You have a pre-application 'conference' (meeting, phone call, or email conversation) with Planning and Zoning staff;
  2. You submit a complete application;
  3. Planning and Zoning staff schedules you for the next Planning Commission hearing and the next reasonable Board of County Commissioners hearing;
  4. The formal resolution with the decision of approval or denial is sent to you;
  5. We update the official zoning map.

3. Required application materials:

  1. completed Rezoning Application form
  2. payment of application fees;
  3. an executed agreement for payment of developmental review (Appendix C);
  4. proof of ownership (warranty deed available from Park County Clerk & Recorder's Office);
  5. a complete legal description of property in question, prepared by a CO licensed land surveyor;
  6. the names and mailing addresses of adjacent property owners (available from Park County Assessor's Office);
  7. if applicable, a signed and notarized mineral estate notice Appendix B
  8. a vicinity map showing where the property is located within Park County;
  9. a map of the property with the following information:
    1. current zone district/s of the property and its adjacent properties;
    2. boundaries of the property;
    3. description of uses on the property and adjacent properties;
  10. a map or written description of the property's current conditions:
    1. topography with a maximum of 10 ft elevation contours;
    2. all property access points, internal roads/trails with widths and approximate grades;
    3. if access is private: proof of permanent legal right of access;
    4. all natural features, including but not limited to: wetlands, floodplains, riparian areas, water bodies, rock outcroppings, significant vegetation, hazards, slopes greater than 25%, etc.;
    5. all utility systems, existing and proposed: wells, sewer, electric, gas, etc.;
  11. a proposed development plan - existing and proposed physical improvements with approximate locations; and
  12. evidence that property taxes have been paid current (tax statement available from Park County Treasurer's Office).

4. Approval criteria:

  1. geological, physical, and other environmental conditions must be compatible with the potential uses permitted in the proposed zone district;
  2. there is a reasonably certain right of permanent legal access connected to public thoroughfare;
    1. above access meets County street/road/driveway standards or such access will be established prior to being issued a building permit;
  3. potential uses of the property within the proposed zone district are compatible with other properties within the immediately surrounding area;
  4. at least one of the following criteria are met:
    1. rezoning is consistent with the Strategic Master Plan;
    2. the proposed rezoning is supported by circumstances and conditions that have changed since adopting current Strategic Master Plan;
    3. the rezoning is to a PUD (please contact Planning staff);
  5. In addition to the above criteria, there are specific zone district requirements:
    1. from M (mining)
      1. The elevation cannot exceed 11,500 ft on the parcel;
      2. you must submit with your application the following documents (they can be obtained from BLM offices @ 2850 Youngfield St, Lakewood, CO):
        1. the patent, plat, field notes, and connected sheets for the mining claim;
        2. land status maps of properties located within 1 mile of the property to be rezoned;
      3. a copy of the USGS quadrangle (topography) area map with the property drawn on the map;
      4. a geo-technical report prepared by a qualified professional using the “Guidelines and Criteria for Identification and Land Use Controls of Geological Hazard and Mineral Resource Areas,” Colorado Geological Survey Publication 6, or the updated version of this publication, which has the following information:
        1. a statement of the engineer's qualifications on geology, mine economics, and geological hazards;
        2. the presence and extent of geological hazards, including underground excavations and radioactive/toxic materials;
        3. the extent of previous mining activities, referring to the USGS topographic map;
      5. a report on the impact of rezoning on present/future nearby mining operations.

NOTE: Upon approval of the rezoning: you must record documentation prepared by the County Attorney disclosing the potential for geologic hazards.

2. to MU (rural center mixed use)

  1. The proposed development includes adequate water and sewer;
  2. The proposed development supports relevant goals and strategies in the Strategic Master Plan; and
  3. The proposed development impacts on nearby residential neighborhoods are considered and mitigated.

3. to A (agricultural)

  1. The parcel must be 35 acres or more if it was created on or after June 1st, 1972.

4. to RVC (recreational vehicle park and campground)

  1. A master site plan must be submitted with the application.
