Survey Correction Plat

1. Definition:

  • The Survey Correction Plat must:
    • correct one or more evident typographical, spelling, or other errors in a legal description OR
    • correct survey errors caused by reasonable reliance on incorrectly located monumentation or inaccurate and officially recognized plat map; AND
    • not create additional lots/out lots OR change any dedicated or publicly owned land or land under public use

2. Procedure:

  1. you have a pre-application 'conference' (meeting, phone call, or email conversation) with the Planning and Zoning Department.
  2. you submit a complete application.
  3. the Planning Director or designee decides on the application within 30 days.
  4. you will be notified and directed to send us a finalized mylar for recording.
  5. we record the mylar and send you a confirmation email.

3. Required application materials:

  1. Completed application form (only sections A, B, and D) in the Survey Correction Plat form
  2. Payment of application fees
  3. Executed Agreement for Payment of Development Review Expenses (Appendix C)
  4. Complete list of names/mailing addresses of owners of properties in the platted area of the Survey Correction Plat (available from the County Assessor's Office)
  5. Proof of ownership and encumbrances for all lots within the plat, OR both
    1. a written, executed and notarized statement of all applicants that they are the fee owners of the properties AND
    2. a certified copy of documentation from the Clerk/Recorder showing that the applicants are the recorded owners of the properties
  6. Final plat meeting following requirements:
    1. drafted at commonly used engineering scale on reproducible drafting medium (outer dimensions: 24" x 36"), also submitted in digital format
    2. title of plat must prominently identify name of recorded subdivision and phrase "Survey Correction Plat", preparation date, scale, north arrow
    3. name, address, phone of applicant, landowner/s, planner, engineer, surveyor (with the signature and seal of the registered land surveyor)
    4. total acreage and surveyed legal description (no +/- dimensions or plat will NOT be approved)
    5. primary boundary survey control points w/ monument descriptions; all parcel/right-of-way lines with lengths and curve data
      1. chord lengths and bearings
      2. basis of bearings and relation to true meridian
      3. must be sufficient to determine closures for rights-of-way, easements, boundaries, lots, outlots, and blocks
    6. name/rights-of-way width of all roads - widths at each leg of intersection, at points of curvature/tangents, at dead ends, and at angle points
    7. locations, dimensions, purposes of all easements
    8. number to identify lots and blocks, letters to identify outlots (in alphabetical order) with information to designate the use of each outlot
    9. identification of public facilities dedicated to public use upon plat approval; no areas within the plat can be designated as areas of conditional, planned, or future public acquisition; dedications of public property not on plat made only by General Warranty Deed recorded with the final plat (unless otherwise approved by the Board of County Commissioners)
    10. names of all adjoining subdivisions with dotted lines of abutting lots, and adjoining unplatted land shown with the owners' name/s
    11. delineation of 100 yr floodplain and any wetlands (if applicable)
    12. approval certifications/plat language forms A-8, and A-1 to A-6 except form A-3
  7. Recording fee (check made payable to Park County Clerk and Recorder)

4. Approval:

  1. Application and proposed survey align with the definition above and do not conflict with any Land Use Regulations.
  2. Corrected plat must be recorded within 10 days of approval by Planning Director or designee at the applicant's expense.
  3. The approval is not in effect until the plat is recorded.
